What is the purpose and legal basis for processing personal data?

Your personal data will be processed for purposes related to the recruitment process for the current or future recruitment, depending on the option selected in the application form, and will be processed on the basis of:
  • Consent to the processing of personal data in accordance with Article 6(1)(a) of the General Data Protection Regulation;
  • Necessity for the performance of a contract to which the data subject is a party, or to take steps at the request of the data subject prior to entering into a contract, in accordance with Article 6(1)(b) of the General Data Protection Regulation;
Providing personal data is voluntary, and failure to provide it will make it impossible to properly carry out the recruitment process.

How long will personal data be processed?

Your personal data will be processed until:
  • withdrawal of consent for the processing of your data, where and to the extent that consent is the basis for processing. You have the right to withdraw your consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal; or
  • the expiry of the data retention period in relation to a given data processing activity or when the data is no longer necessary for the purpose pursued by the controller, and there are no legal grounds to process the personal data on another legal basis;
  • compliance with a legal obligation, until the limitation period for claims expires or the deadlines related to data retention obligations lapse;

To whom may your personal data be disclosed?

Your personal data may be disclosed to a client seeking an employee in the case of processing by a Temporary Employment Agency as part of job placement services.

Your personal data may also be processed by external partners supporting our business processes, i.e. so-called data recipients (processors), including IT solution providers, technical support providers, external entities supporting the data controller in IT security, marketing or sales processes, as well as within Wind Transport Sp. z o.o.

Your personal data will not be disclosed to other entities acting as independent data controllers, unless required by law or unless appropriate consent has been given for the disclosure of specific personal data for a specified purpose.

Personal data may be transferred to third countries only if the data controller has an appropriate legal basis, including on the basis of an adequacy decision or subject to appropriate safeguards (e.g. binding corporate rules or standard contractual clauses).

What rights arise from personal data protection?

You have the right to lodge a complaint with a supervisory authority, the right to request access to your personal data from the controller, as well as to request their rectification, erasure, or restriction of processing. You also have the right to object to processing and the right to data portability. The data controller does not intend to use automated decision-making, including profiling.

What are the consequences of not providing personal data?

Providing personal data is entirely voluntary; however, if the data is not provided, the data controller will not be able to carry out the recruitment process.
